Understanding the Agreement Before You Sign
A written retainer agreement explains the terms of the attorney-client relationship. Read the entire agreement and ask questions about anything that is unclear before signing. The terms may vary depending on the firm and the type of matter.
Important Terms to Review
- The work the attorney has agreed to perform and any work that is excluded
- How legal fees are calculated, billed, and paid
- Whether an advance deposit must be replenished
- Which expenses may be charged separately
- Your responsibilities for providing information, attending proceedings, and making decisions
- How the firm communicates, sends bills, and handles questions
- How either side may end the representation and how the client file will be handled
Keep a copy of the signed agreement and review each invoice promptly. Raise questions while the work and billing entries are still recent. Representation generally begins only after the required agreement is signed and any stated initial payment or other condition has been satisfied.
