Understanding a New York Attorney Retainer Agreement & Fees

Professional signing a written agreement.

A written retainer agreement explains the terms of an attorney-client relationship in a New York legal matter. Read the full agreement and ask questions about any term that is unclear before you sign. The details vary by firm and by the type of matter.

Terms to Review Before You Sign

  • The work the attorney has agreed to perform and any work that is excluded.
  • How legal fees are calculated, billed, and paid.
  • Whether an advance deposit must be replenished and which expenses may be charged separately.
  • Your responsibilities for providing information, attending proceedings, and making decisions.
  • How the firm communicates, sends bills, addresses questions, and handles the end of representation.

Keep Records and Ask Questions Promptly

Keep a copy of the signed agreement and review invoices while the work and billing entries are still recent. Representation generally begins only after the required agreement is signed and any stated initial payment or other condition has been satisfied.
